Biography

Marc B. Cytryn represents management in a wide array of employment matters, including restrictive covenant issues, trade secrets disputes, employment discrimination cases, and class and collective wage and hour actions under the FLSA and corresponding state laws. He is well-versed in handling union benefit fund and withdrawal liability issues under ERISA.

Marc provides strategic counseling to employers on human resources challenges, emphasizing claim prevention, risk mitigation, and compliance with both federal and state employee leave, and wage and hour regulations. He collaborates closely with clients to develop robust employment policies and assists in the drafting of employment agreements, compensation plans, and severance agreements.

In addition to his employment practice, Marc is adept at handling business divorce and shareholder disputes, including exit strategies, buyouts, and shareholder conflicts.   • Guided a solar contractor through an audit by the New Jersey Department of Labor, Wage & Hour Division, and negotiated a favorable resolution.
  • Obtained a favorable settlement, which included post-employment restrictions despite the absence of a written agreement, in trade secret litigation against a former employee of a telecommunications contractor.
  • Defended an HVAC manufacturing company against allegations of disability discrimination and FMLA violations brought by an employee.
  • Obtained temporary restraining order and preliminary injunction against competitor and former sales representatives of solar company pursuant to the New Jersey Trade Secrets Act.

  • Obtained dismissal of former employee’s claim for religious discrimination under Title VII on behalf of start-up running company in Virginia federal court.

  • Negotiated favorable settlement for New Jersey contractor assessed with more than $5.2 million in withdrawal liability under ERISA.

  • Advised a client on company governance documents and procedures, successfully negotiating an eight-figure buyout for a minority member's equity interest, alongside favorable terms for the client's employment separation, thus avoiding litigation.

  • Secured a favorable settlement for a client by obtaining a preliminary injunction in federal court, resulting in minority members relinquishing their interests.

  •  Guided a client holding a 50% membership interest to reach a deal to expel the other 50% equity holder, thereby gaining total control of the company.
